CBIC prohibits the sale of health supplements containing PABA, a banned ingredient

The Central Board of Indirect Taxes and Customs (CBIC) on July 24, 2020 has issued instructions subject to the prohibition of selling of health supplements containing PABA (Para Amino Benzoic Acid), a banned ingredient.

The Food Safety and Standards Authority of India (FSSAI) had issued an order on June 29, 2018 vide order no. Stds/Nutr(DGCI)/FSSAI-2017 (Pt. I) specifying the ban on the usage of PABA in the products covered under Nutraceuticals Regulations. The Department has reiterated the Para 2 in the order, which states,

“Para 2 directs FBO’s that no further manufacturing of products using this ingredient is allowed. Any product containing such ingredient which is already manufactured/imported shall be withdrawn from the market immediately. However, it has come to the notice that several health supplements and nutraceutical products containing PABA are still being sold on e-commerce platform.”

All the customs officials working as Authorized officers must ensure that imported products containing banned ingredient shall not be cleared through point of entries. It is mandatory compliance for trade.

CBIC issues instruction for mandatory testing and certification of Telecommunication Equipment

The Central Board of Indirect Taxes and Customs (CBIC) on July 24, 2020 has issued instructions subject to mandatory testing and Certification of Telecommunication Equipment (MTCTE). The department has reiterated the paragraph one given in the notification issued by the Department on June 23, 2020 vide notification no. TEC/01/2017-TC which specifies operational guidelines to be followed. 

“Telecommunication Engineering Centre has notified that testing and certification for telecommunications equipment under phase-II of Mandatory Testing and Certification of Telecommunications Equipment (MTCTE) regime as provisioned in India Telegraph (Amendment) Rules 2017, shall be mandatory with effect from October 01, 2020:

• Transmission Terminal Equipment (SDH Equipment, Multiplexing Equipment).

• PON family of Broadband Equipment (PON ONT, PON ONU and PON OLT). 

• Feedback Device.”

The Department has further clarified that suitable instructions shall be issued from time to time.

CBIC amends the class of goods to be deposited in special warehouses licensed under the Customs Act, 1962

The Central Board of Indirect Taxes and Customs (CBIC) on July 27, 2020 has issued a notification to amend the notification issued on May 14, 2016 vide Notification No. 66/2016- Customs (N.T.) which specifies the class of goods that shall be deposited in a special warehouse licensed under the Customs Act, 1962. 

• Clause (1) which specifies the class of goods has been substituted in the said notification which states, “gold, silver, other precious metals and articles thereof”.

CBIC modifies tariff value of crude oil, poppy seeds, crude soya bean oil and RBD Palm Oil on July 27, 2020

The Central Board of Indirect Taxes and Customs (CBIC) on July 27, 2020 has issued a notification to amend the notification issued on August 3, 2001 vide no. 36/2001- Customs (N.T.) which specifies the fixation of tariff value of the following goods: 

• Crude Oil 

• RBD Palm Oil 

• Others- Palm Oil 

• Crude Palmolein 

• RBD Palmolein 

• Others- Palmolein

• Crude Soya Bean Oil

• Brass Scrap (all grades)

• Poppy Seeds

The Table 1, 2 and 3 provided in the Notification will be substituted for the existing tables in its parent Notification. These tables contain the details about Chapter headings, descriptions of goods and tariff value.

UGC revises curriculum based on Learning Outcomes based Curriculum Framework

The University Grants Commission (UGC) on June 24, 2020 has requested all Universities to adopt Learning Outcomes based Curriculum Framework (LOCF) in all higher education institutions by updating curriculum from academic year 2019-20 and adopting learner centric teaching learning processes by suitable improvement in the pedagogy. The UGC has formed a specific Expert Committees to facilitate the task.

The Committee thus has developed reports LOCF report for different subjects. For implementation of outcome oriented curriculum to achieve expected outcomes, final LOCF reports of 25 subjects are available on the website of UGC (www.ugc.ac.in). Along with it, one more subject, Computer Science is also added.  All universities are hereby requested to send action report in this regard to locfugc@gmail.com  and neethuthulasi.ugc@gov.in.

UGC extends the last date for submission of online application for NSQF

The University Grants Commission (UGC) on June 30, 2020 invites applications from institutions for running skill-based programmes under National Skills Qualifications Framework (NSQF) for the academic year 2020-21. The applications shall be submitted through online portal. The last date for submission of the applications has now been extended from June 30, 2020 to July 20, 2020.

UGC issues Standard Operating Procedure for conduct of examinations

The University Grants Commission (UGC) on July 08, 2020 issues the Standard Operating Procedure (SOP) for conduct of examinations.

The following SOP has been issued:-

Ø  The instructions, guidelines and orders issued by Central and State Governments to be followed concerning the opening of educational institutions and safety and health.

Ø  The identity cards issued to the students should be treated as pass for movement of students.

Ø  Examination centre floors, washrooms, classrooms, restrooms should be sprayed with disinfectant.

Ø  Senior staffs should monitor the entry and exit and should be proper markings with at least two meter distance where students shall stand in a queue.

Ø  Students having symptoms of fever, cough and cold should be either made to sit separately.

Ø  Cleanliness and hygienic conditions as per safety and health advisories of the concerned government departments are to be maintained at all places.

Ø  Proper signages, symbols, posters etc. should be displayed at appropriate place to maintain social distancing.

MoLE amends Schedule II of the Notification regarding exemption to certain establishments from the first proviso of the section 6

The Ministry of Labour and Employment (MoLE) on May 18, 2020, amends the Schedule II of the Notification dated April 09, 2020 regarding exemption to certain establishments from the first proviso of the section 6 of the Employees’ Provident Funds and Miscellaneous Provisions Act, 1952, which specifies the amount to be contributed by the employers and employees and matters which may be provided for in Scheme.

In SCHEDULE II, after clause (iv), the following clause shall be inserted, namely:

Clause (v): Any establishment, other than Central Public Sector Enterprises and State Public Sector Enterprises and other establishments owned by, or under the control of the Central Government or the State Government, as the case may be, in respect of wages payable by it for the months of May, June and July, 2020.

Provided that this clause will not be applicable to the establishments eligible for relief under the Pradhan Mantri Garib Kalyan Yojana.

EPFO extends the validity period of PMGKY package for credit of employer’s and employee’s contribution

The Employees Provident Fund Organisation on July 14, 2020 has decided to extend the validity period of Scheme for implementation of PMGKY package for credit of employer’s and employee’s contributions (24% of wages) by Government of India. The government has decided to pay 24 percent of monthly wages under the PMGKY scheme for three months to all the workers earning below 15,000 rupees per month and to support establishments employing up to one-hundred employees, with 90 percent employees.

The extension of this scheme has been approved by the competent authority considering the Atmanirbhar Bharat Abhiyan.

The Competent Authority has approved the extension of the existing benefit under the aforesaid scheme for three months under Atmanirbhar Bharat Abhiyan. Therefore, the clause 3 of the Scheme is amended to the extent that the Scheme shall be in operation for wage months of March 2020, April 2020, May 2020, June 2020, July 2020, and August 2020

EPFO issues circular for settlement of death claims on priority basis in case of industrial accidents

The Employees Provident Fund Organisation (EPFO) on July 17, 2020 has issued a circular for settlement of death claims on priority basis in events of industrial accidents etc. It has been stated by the organisation that immediate actions shall be taken in such events and the concerned RPFC must take immediate action for the same.

The concerned RPFC should depute an EO to figure out the complete details of the incident and death from the establishment and due guidance shall be taken in such accord, so that immediate filing of claims can take place under the EPF Act.
