Odisha Government extends the timeline for issue of notice for the rejection of refund claim

The Odisha Finance Department on July 2, 2020 issued a notification amendment in the notification issued by the department on June 22, 2020 vide notification no. 18548-FIN-CTI-TAX-0002/2020 which specifies the extension of the notice filed for the rejection of refund claim to be extended for 15 days.

The department has further substituted the date June 29, 2020 to August 30, 2020 which specifies the issue of notice for the refund claim. The Department has further substituted June 30, 2020 to August 31, 2020 which specifies the reply by the registered person for the issue of notice.

Ministry of Finance issues clarification on applicable GST rates on alcohol-based hand sanitisers

The Ministry of Finance on July 15, 2020 has issued a press release to provide clarification on GST rates applicable on alcohol-based hand sanitisers. The Ministry has further clarified that the GST rates applicable on alcohol-based hand sanitisers is 18 percent which has been decided by the Central and State Government.

Further, the Ministry stated that the rates of GST cannot be reduced since it will affect the domestic manufacturers and the import of the sanitisers, thus leading to inverted duty structure. Thus, the sanitisers will become cheaper affecting the policy on Atmanirbhar Bharat. Plus, consumers would not be able to take benefits from lower GST rates.

CBIC extends due date of Form GSTR – 4 for the financial year 2019-2020

The Central Board of Indirect Taxes and Customs (CBIC) on July 13, 2020, extends the due date of filing form GSTR-4 till August 31, 2020 by amending the Notification No. 21/2019- Central Tax dated April 23, 2029, which specifies the guidelines for registered persons paying taxes under Section 10 of the Central Goods and Service Tax Act, 2017, which is related to composition levy.

For extension, CBIC amends the first proviso of the third paragraph of the Notification, to extend the due of Form GSTR-4 till “August 31, 2020” instead of “July 15, 2020”.

The taxpayers whose turnover is below Rs 1.5 crore can opt for Composition levy and have to file form GSTR-4 on yearly basis.

CBIC issues a letter for AGMARK certification for import of Blended Edible Vegetable Oil

The Central Board of Indirect Taxes and Customs (CBIC) on July 10, 2020 issued a letter for the requirement of AGMARK certification prior to import of blended edible vegetable oils (BEVO). Where the department has clarified that the import of BEVO is not allowed in India without an AGMARK certification. Further, BEVO shall also comply with the regulations and rules mentioned in the FSS Act, 2006.

UGC issues Circular upon regarding payment of semester fees to universities and colleges

The University Grants Commission (UGC) on May 27, 2020, has issued a Circular regarding payment of fees to universities and colleges. UGC had received representations from students and parents stating that universities and colleges are asking for an immediate payment of annual or semester tuition fee, examination fee, etc. It is represented that due to the financial hardship being faced due to the lockdown, they are not in position to make payment of fee.

Therefore, UGC has requested the universities and colleges to consider the matter regarding payment of annual or semester fee, tuition fee, examination fee, etc. and if possible, may consider offering alternative payment options to students till the situation returns to normal.

UGC revises curriculum based on Learning Outcomes based Curriculum Framework

The University Grants Commission (UGC) on June 24, 2020 has requested all Universities to adopt Learning Outcomes based Curriculum Framework (LOCF) in all higher education institutions by updating curriculum from academic year 2019-20 and adopting learner centric teaching learning processes by suitable improvement in the pedagogy. The UGC has formed a specific Expert Committees to facilitate the task.

The Committee thus has developed reports LOCF report for different subjects. For implementation of outcome oriented curriculum to achieve expected outcomes, final LOCF reports of 25 subjects are available on the website of UGC (www.ugc.ac.in). Along with it, one more subject, Computer Science is also added.  All universities are hereby requested to send action report in this regard to locfugc@gmail.com  and neethuthulasi.ugc@gov.in.

Bihar Goods and Service Tax (Sixth Amendment) Rules, 2020

The State Government of Bihar on July 2, 2020, publishes the Bihar Goods and Services Tax (Sixth Amendment) Rules, 2020, to further amend Bihar Goods and Service Tax Rules, 2017. 

Following amendments have been made to Bihar Goods and Service Tax Rules, 2017:

  • In Rule 26 (1) which specifies the procedure for return filing, a second proviso has been inserted namely: Provided further that a registered person registered under the provisions of the Companies Act, 2013 shall, during the period from April 21, 2020 to September 30, 2020, also be allowed to furnish the return under section 39 in FORM GSTR-3B verified through electronic verification code (EVC)”.
  • Further, all those people who are registered under the provisions of the Companies Act, 2013 shall, during the period of May 27, 2020 to September 30, 2020 shall furnish the details of outward supplies under Section 37 in Form GSTR-1 verified through electronic verification code.

Bihar Goods and Services Tax (Removal of Difficulties) Order, 2020

The State Government of Bihar on June 30, 2020, publishes the Bihar Goods and Services Tax (Removal of Difficulties) Order, 2020, to further extend the time limit for filing an application for revocation of cancellation of registration for specified taxpayers.

Whereas, the taxpayers could not apply for revocation of cancellation within the specified time period of thirty days from the date of service of the cancellation order, as a result whereof certain difficulties have arisen in giving effects to the provisions of section 30(1) of the Bihar Goods and Services Tax Act, 2017, which talks about revocation of cancellation of registration.

Therefore, it is clarified that for the purpose of calculating the period of thirty days for filing application for revocation of cancellation of registration for those registered persons who were served notice in the prescribed manner and where cancellation order was passed up to June 12, 2020, the later of the following dates shall be considered:

  • Date of service of the said cancellation order; or
  • August 31, 2020.

ESIC issues provisions of prompt medical services to be provided to ESI beneficiaries under COVID pandemic

The Employee State Insurance Corporation (ESIC) on June 11, 2020, issues provisions for prompt medical services to ESI patients at all the ESIC hospitals during the COVID-19 pandemic. It was observed that some of the hospital were not admitting the patients and were further directing them to a different hospital adding up to the misery of the sick patients.

To eradicate the negligent behaviour towards the ESI patients, the corporation has given out certain guidelines which are to be followed by all the ESIC hospital and be provided to ESI beneficiaries.

  • All the patients are to be treated on emergency basis in case they are a suspected or a confirmed case of COVID.
  • The beds are to be provided in the separate isolation wards for all these patients along with all the equipment needed for the treatment.
  • The hospitals should arrange for the transport of the sick patients and should reserve the bed for the patients.
  • The ambulance and the transport services shall be provided on a 24-hour basis.

ESIC adopts the circular regarding extension of validity of CGHS in view of the Corona Virus

The Employees’ State Insurance Corporation (ESIC) on June 04, 2020, adopts the circular regarding extension of validity of Central Government Health Scheme Cards (CGHS) in view of the Covid-19 infection that is issued by the Ministry of Health and Family Welfare (MoHFW).

According to the Circular: 

  • In case of pensioner beneficiaries whose CGHS cards are valid up to March 31, 2020, the validity date may be extended up to July 31, 2020 in the database on the basis of request received form beneficiaries
  • If a request is received by email from serving employees who superannuated on March 31, 2020, are thereafter not in receipt of Pension Payment Order (PPO), the CGHS card may be converted as pensioner CGHS card. 
  • If a Government Servant superannuating on March 31, 2020 and was not a member of CGHS during service then he will have to submit a proof of the superannuation.

These relaxations are only to help beneficiaries in Covid -19 and will not be a precedent.
