CBIC issues instructions to Customs regarding requirement of Veterinary Certificate for Import of milk and milk products into India

The Central Board of Indirect Taxes and Customs (CBIC) on May 20, 2020, issues instruction to the Customs regarding requirement of Veterinary Customs for Import of milk and milk products into India.

Whereas, Food Safety and Standard Authority of India (FSSAI) issued letter on May 15, 2020 requesting CBIC to issue necessary instructions to filed formations of Customs regarding requirement of veterinary certificate for import of dairy products including edible lactose.

To ensure compliance of imported dairy products to FSSR, it has been mandated that consignments of dairy products imported into India shall be accompanied with veterinary certificate. But, this requirement is not being insisted by customs for those consignments of edible lactose which are facilitated through green channel by RMS which created differential treatment of facilitated and non-facilitated consignments.

Therefore, CBIC instructs Customs to mandate veterinary certificate for import of milk and milk products into India.

UGC announces running skill programme for the academic year 2019-20

The University Grants Commission (UGC) on June 04, 2019, has issued a public notice in order to announce the running skill programmes for the academic year 2019-2020. Any institution desirous of offering skill based courses from the year at the level of certificate, diploma, advance diploma, B.Voc./M.Voc. may apply on the UGC portal ugc.aicte-india.org. The UGC specifies who should apply and submission of application. 

The permission for running the skill programs and for providing funding will be separate. The application called for is only for grant of permission for running the skill courses. The institutions are encouraged to run the courses by generating their own resources and in case of funding, it shall be only on the following terms:

  1. The training facilities and the infrastructure could be funded by the Central Government.
  2. The training facilities could be run by industry concerned or such other third party agencies and the cost of vocational instructors could be met by the State Government.
  3. The consumables and recurring expenditure for the training shall be collected as a fee from the students.

The last date of submission of application on the portal is July 01, 2019.

ESIC adopts the circular regarding extension of validity of CGHS in view of the Corona Virus

The Employees’ State Insurance Corporation (ESIC) on June 04, 2020, adopts the circular regarding extension of validity of Central Government Health Scheme Cards (CGHS) in view of the Covid-19 infection that is issued by the Ministry of Health and Family Welfare (MoHFW).

According to the Circular: 

  1. In case of pensioner beneficiaries whose CGHS cards are valid up to March 31, 2020, the validity date may be extended up to July 31, 2020 in the database on the basis of request received form beneficiaries
  2. If a request is received by email from serving employees who superannuated on March 31, 2020, are thereafter not in receipt of Pension Payment Order (PPO), the CGHS card may be converted as pensioner CGHS card. 
  3. If a Government Servant superannuating on March 31, 2020 and was not a member of CGHS during service then he will have to submit a proof of the superannuation.

These relaxations are only to help beneficiaries in Covid -19 and will not be a precedent.

CBIC extends the due date for furnishing of FORM GSTR 9 and FORM 9C for FY 2018-19

The Central Board of Indirect Taxes and Customs (CBIC) on May 05, 2020, extends the due date for furnishing of FORM GSTR 9 and FORM 9C for FY 2018-19 till September 30, 2020.

Therefore, CBIC extends the time limit for furnishing of the annual return specified under section 44 of the Central Goods and Services Tax Act, 2017, electronically through the common portal, for the financial year 2018-2019 till September 30, 2020.

Indian Medicine Central Council (Minimum standards of Education in Indian Medicine) Amendment Regulations, 2019

The Central Council of Indian Medicine on June 18, 2019, has published the Indian Medicine Central Council (Minimum standards of Education in Indian Medicine) Amendment Regulations, 2019 to further amend the Indian Medicine Central Council (Minimum standards of Education in Indian Medicine) Regulations, 1986. 

The amendments are made in Schedule-I, n Schedule-II and Schedule-III of the Indian Medicine Central Council (Minimum standards of Education in Indian Medicine) Regulations, 1986. They shall come into force on the date of their publication in the Official Gazette that is on June 18, 2019.

These Regulations shall apply to students who shall be admitted for Bachelor of Ayurvedic Medicine and Surgery (B.A.M.S.), Bachelor of Siddha Medicine and Surgery (B.S.M.S.) and Bachelor of Unani Medicine and Surgery (B.U.M.S.) from the commencement of the academic session (2019-2020).

ESIC issues provisions of prompt medical services to be provided to ESI beneficiaries under COVID pandemic.

The Employee State Insurance Corporation (ESIC) on June 11, 2020, issues provisions for prompt medical services to ESI patients at all the ESIC hospitals during the COVID-19 pandemic. It was observed that some of the hospital were not admitting the patients and were further directing them to a different hospital adding up to the misery of the sick patients.

To eradicate the negligent behaviour towards the ESI patients, the corporation has given out certain guidelines which are to be followed by all the ESIC hospital and be provided to ESI beneficiaries.

  • All the patients are to be treated on emergency basis in case they are a suspected or a confirmed case of COVID.
  • The beds are to be provided in the separate isolation wards for all these patients along with all the equipment needed for the treatment.
  • The hospitals should arrange for the transport of the sick patients and should reserve the bed for the patients.
  • The ambulance and the transport services shall be provided on a 24-hour basis.

UGC issues Notification regarding prevention of caste based discrimination in Higher Education Institutions

The University Grants Commission (UGC) on June 26, 2019, has issued a Notification regarding the prevention of caste based discrimination in higher education institutions. The UGC is continuously monitoring the prevention of caste based discrimination and thus requested all the universities, institutes and college to develop a page on their website for lodging complaints of caste discrimination by SC/ST students and also place a complaint register in the Registrar’s or Principal’s office. Every officials or faculty members should desist from any of discrimination against SC/ST students on grounds. The University and colleges should ensure that no official or faculty members indulge in any kind of discrimination against any community of students. The University may constitute a committee to look into the discrimination complaints received from the SC/ST/OBC students or teachers and non-teaching staff. If any such incident comes to the notice of the authorities, action should be taken against the erring official or faculty members promptly.

Every officials are requested to deal with the incidents of caste discrimination very sensitively and send the Action taken Report to UGC within thirty days in the prescribed format (Page 2) at the email id: sctsection@gmail.com

CBIC withdraw the concession available to the import of Bamboo and levy a uniform rate of 25% on import of Bamboos

The Central Board of Indirect Taxes and Customs (CBIC) on June 9, 2020, amend the Notification №50/2017-Cus dated June 30, 2017 so as to withdraw the concessional rate of 10% available to the import of Bamboo for the manufacture of Agarbattis, and to levy a uniform rate of 25% on import of Bamboos.

CBIC clarifies refund related issues on Input Tax Credit

The Central Board Indirect Taxes and Customs (CBIC) on June 10, 2020, clarifies on refund related issues on Input Tax Credit in respect of invoices whose details are not reflected in the FORM GSTR-2A of the applicant.

CBIC after examining the matter and decided that the refund of accumulated ITC shall be restricted to the ITC as per those invoices, the details of which are uploaded by the supplier in FORM GSTR-1 and are reflected in the FORM GSTR-2A of the applicant.

This order does not in any way impact the refund of ITC availed on the invoices / documents relating to imports, ISD invoices and the inward supplies liable to Reverse Charge (RCM supplies) etc. It is hereby clarified that the treatment of refund of such ITC relating to imports, ISD invoices and the inward supplies liable to Reverse Charge (RCM supplies) will continue to be same as it was before the issuance of Circular No. 135/05/2020- GST dated March 31 2020.

Government of Bihar relaxes certain provisions under GST Act 2017 amid Covid-19 crisis

The State Government of Bihar on June 09, 2020 has provided relaxation in certain compliance under the Bihar Goods and Services Tax Act, 2017 due to the spread of COVID-19 pandemic.

It is notified that:-

The time limit for completion of compliance by any authority or by any person falling during the period from March 20, 2020 to June 29, 2020 is extended up to June 30, 2020 for the purpose of completion of any proceeding or passing of any order or issuance of any notice, intimation, notification, sanction or approval or such other action.

The validity period for any e-way bill generated under rule 138 of the Bihar Goods and Services Tax Rules, 2017 has been extended till May 31, 2020.

This Notification shall come into force with effect from March 20, 2020.
